- The investor submits 02 sét of application for construction permit to the competent agency for granting construction permit;
- The competent agency for granting construction permit is responsible for receiving applications of organizations and individuals applying for construction permits; checking the application; writing a receipt in case the application meets regulations or providing guidance to the investor to complete the application in case the application fails to meet regulations;
- Within 07 working days from the date of receiving the application, the competent agency for granting construction permit shall organize appraisal and field inspection. When appraising the application, the competent agency shall determine the missing documents, the improper documents in accordance with regulations or reality to notify the investor in writing once in order to supplement and complete the application. In the event that the additional documents fail to meet the requirements of the written notice, within 05 working days, the competent agency shall take its responsibility for giving the written notice on providing guidance to the investor in order to continue completing the application. The investor is responsible for supplementing and completing the application in accordance with the written notice. In the event that the supplementation of application still fails to satisfy the notified contents, within 03 working days, the competent agency shall take its responsibility for notify the investor of the reason for not granting the permit;
- Based on the size, nature, type of work and location of work construction included in the application for construction permit, the competent agency for granting construction permit is responsible for comparing the conditions under this Law to submit documents and consult state management agencies in terms of fields in relation to construction works under the law;
- Within 12 days for private works and houses from the date of receipt of application, the consulted state management agencies are responsible for replying in writing on the contents of their management function. After this duration, if these agencies have no opinion, it is considered to have agreed and they shall be responsible for the contents of their management function; the agency granting construction permit shall base on the applicable regulations to decide the grant of construction permit;
- From the date of receipt of complete and valid application, the competent agency for granting construction permit shall review the application to grant the permit within 30 days for cases of grant of construction permit, including defined term and 15-day construction permits for the private houses. In case the duration for grant of construction permit is reached but further review is required, the agency granting construction permit shall give the written notice to the investor of reason, and report to the competent direct management authority for consideration and directing execution, but not more than 10 days from the prescribed expiration date.
